These Terms and Conditions govern the use of the website gioielleriartiorafe.it and the online sale of products marketed by Arti Orafe, a trade name of NESI SPARTACO – Ditta Individuale.

2. Scope of Application
These Terms and Conditions apply to all orders placed through the gioielleriartiorafe.it website.
Sales are exclusively aimed at adult end consumers. No B2B sales are conducted through this site.
By placing an order, the customer declares to have read, understood, and accepted these Terms and Conditions.
3. Products
Arti Orafe markets jewelry made of gold, silver, diamonds, precious stones, and other jewelry items.
The products are handcrafted. Any slight differences in color, finish, size, shade, or detail compared to the images published on the website do not constitute a defect, but a natural characteristic of the materials and artisanal craftsmanship.
Product images are for illustrative purposes. Color rendering may vary depending on the device used by the customer.
Any information relating to weights, dimensions, carats, measurements, or technical specifications is indicated with the greatest possible accuracy, subject to slight physiological tolerances related to the nature of the products.
4. Product Availability
Product availability is indicated on the website at the time of purchase.
In case of unavailability after the order, Arti Orafe will promptly inform the customer and may propose:
- replacement with an equivalent product;
- waiting for restocking, if possible;
- a refund of the amount paid.
5. Prices
Product prices are indicated on the website in the currency selected by the customer.
Arti Orafe reserves the right to modify prices at any time. The price applied will be that displayed at the time of order confirmation.
For orders destined for non-EU countries, any customs duties, import taxes, local fiscal charges, or customs clearance costs are the responsibility of the customer, unless otherwise indicated during checkout.
6. Orders
To place an order, the customer selects the desired products, adds them to the cart, and completes the checkout process via Shopify.
Placing an order constitutes a purchase proposal. The contract is considered concluded when the customer receives order confirmation.
Arti Orafe reserves the right to refuse, cancel, or limit an order in case of:
- incomplete, inaccurate, or unverifiable data;
- unauthorized or incomplete payment;
- suspected fraud or misuse of the site;
- obvious error in price or product description;
- product unavailability.
7. Payments
Payments can be made using the methods available at checkout, including payment card via Shopify Payments and PayPal.
Complete data related to payment instruments is not stored by Arti Orafe but managed by the respective payment providers according to their security standards.
8. Shipping and Delivery
Arti Orafe ships to Italy, the European Union, and non-EU countries.
The processing and delivery times indicated on the website are estimated and not guaranteed. Any delays due to couriers, holidays, extraordinary events, customs controls, or force majeure cannot be attributed to Arti Orafe.
The customer is responsible for the accuracy of the shipping address indicated during the order process.
Upon delivery, the customer is invited to check the integrity of the package. In case of a damaged, tampered with, or visibly altered package, the customer is invited to accept with reservation, if possible, and to contact Arti Orafe within 48 hours of delivery.
9. Right of Withdrawal
The consumer customer has the right to withdraw from the purchase within 14 days of receiving the product, without needing to provide any reason.
To exercise the right of withdrawal, the customer must communicate their decision by sending an email to info@gioielleriartiorafe.it, indicating the order number, name, surname, and the product they intend to return.
The product must be returned without undue delay and in any case within 14 days from the communication of withdrawal.
10. Return Conditions
The returned product must be:
- intact;
- unused;
- undamaged;
- complete with original packaging, certificates, warranties, labels, and any included accessories;
- suitable for resale.
Arti Orafe reserves the right to refuse the return or reduce the refund in case of a decrease in the product's value due to unnecessary handling, improper use, damage, alterations, or missing original elements.
11. Return Costs
The direct costs of returning the product are borne by the customer.
The customer is responsible for the return shipment until it is delivered to Arti Orafe. It is advisable to use a traceable and adequately insured service, especially for valuable products.
12. Refunds
Once the returned product is received and verified, Arti Orafe will process the refund of the due amounts within 14 days.
The refund will be made using the same payment method used by the customer for the purchase, unless otherwise expressly agreed.
Additional shipping costs or ancillary services chosen by the customer may not be refundable within the limits allowed by law.
13. Merchandise Exchange
Product exchange is not guaranteed and is subject to item availability.
Arti Orafe reserves the right to prioritize a refund over a merchandise exchange.
Any price differences, shipping costs, or availability will be communicated to the customer before confirming the exchange.
14. Legal Guarantee of Conformity
The products sold are covered by the legal guarantee of conformity provided by the applicable consumer protection regulations.
The guarantee covers conformity defects existing at the time of product delivery.
The guarantee does not cover:
- damage caused by improper use;
- bumps, falls, or accidental damage;
- normal wear and tear of the product;
- alterations, repairs, or interventions carried out by unauthorized third parties;
- damage caused by contact with chemical agents, perfumes, detergents, cosmetics, or non-compliant use.
15. Jewelry Care
Jewelry must be stored and used with care. It is advisable to avoid contact with water, perfumes, creams, detergents, chemical substances, impacts, heat sources, and environments that could damage materials, stones, or finishes.
16. Customer Responsibility
The customer is responsible for:
- the accuracy of the data provided;
- the choice of size or product purchased;
- the proper storage and maintenance of the jewelry;
- using the website in compliance with the law and these Terms.
17. Limitation of Liability
Arti Orafe cannot be held liable for indirect damages, delays not attributable to the seller, third-party service disruptions, technical problems, force majeure, customs delays, improper use of products, or incorrect information provided by the customer.
18. Intellectual Property
All content on the website, including texts, photographs, logos, graphics, descriptions, layout, and visual materials, are protected by intellectual property laws.
Reproduction, distribution, modification, or unauthorized use of the content on the website is prohibited.
19. Privacy

For consumers, the jurisdiction of the court of the consumer's place of residence or domicile remains valid, where provided by applicable law.
